As a general rule, community sentence will continue as long as it is practically possible, respecting the current infection control rules.
 
Depending on the infection situation, certain adjustments as to how community sentence can be implemented must be taken into consideration. One decisive factor is to ensure that infection control rules from national health authorities can be respected, at the same time as staff members and convicted persons can be protected towards infection.

Physical visits to the Correctional Service

The contact between the convicted person and the staff member should to the largest extent possible be digital and/or by telephone. 

Physical visits to probation office, drug court center etc., shall be restricted to cases with extraordinary reasons for physical attendance by the convicted person. 

When deciding whether the convicted person should be allowed to have physical visits to the correctional service, it should be assessed whether this is regarded as a secure measure. 

KDI stresses that persons sentenced to preventive detention and released on parole will continue to be followed up, and the probation offices are tasked to make thorough and individual assessments concerning how the sentenced person shall be followed up, and how the terms shall be monitored. 

Group activities

Until further notice is given, group activities in connection with community sentence are suspended.

It can be considered to allow for exceptions, such as outdoor activities, in case the infection control measures can be ensured. In such cases, a general assessment of the infection control situation must be made.

Transfer of inmates from prison to execution of sentence by means of electronic monitoring, due to capacity problems in prisons

Convicted persons can be transferred from prison to executing the sentence by means of electronic monitoring, if it is necessary to reduce the number of inmates because of infection control measures.  In such cases, convicted persons must meet certain criteria, and it must be regarded as safe. 

Execution of sentence by means of electronic monitoring - employment

In geographical areas with high infection rates/local outbreaks, it can be difficult to fulfill the requirement of being employed while executing the sentence by means of electronic monitoring. 

The following exceptions are therefore in force until further notice is given: In case the convicted person who is executing the sentence by means of electronic monitoring is required to be in quarantine or isolated, or in case the place of employment is closed, the requirement to be employed is disregarded, in case it is not possible to work from home. 

Interruption of sentence when executing community sentence

The Correctional service can decide to interrupt the execution of community sentence, sentence for unpaid fines and programme against intoxicated driving, when it is impossible to execute the sentence because of instructions or recommendations from national health authorities, or because of changes at the cooperation partners of the correctional service. 

KDI asks the probation offices to find alternative solutions for activation of convicted persons, in such a way that the execution of sentence only is interrupted in cases when it is regarded as strictly necessary.
